Consent to Participate in the Beta Software Program​

I hereby consent to participate in the WIBS International Ltd. Beta Software Program (“Beta Program”) and agree to be bound by all the terms and conditions of the WIBS International Ltd. Beta Software Program Agreement (“Agreement”). I understand that participation in the Beta Program is voluntary and that my participation does not create a legal partnership, agency, or employment relationship between me and WIBS International Ltd.

I certify that I am of the legal age of majority in the jurisdiction in which I reside (at least 18 years of age in many countries) and that I am legally permitted to join the Beta Program. If I am not of legal age, I acknowledge and agree that I have obtained the permission of my parent or legal guardian. I understand that this Agreement is void where prohibited by law.

I understand that by participating in the Beta Program, I may have access to alpha, beta, seed, and other pre-release software, pre-release services, and related documentation, materials, and information (collectively, the “Pre-Release Software”) for the purpose of providing feedback to WIBS International Ltd. on the quality and usability of the Pre-Release Software. I agree to use and evaluate the Pre-Release Software diligently and to provide feedback to WIBS International Ltd. in accordance with the terms of the Agreement.

I understand that WIBS International Ltd. may modify the terms, conditions, and policies of the Beta Program at any time without notice, and that my participation in the Beta Program may be revoked by WIBS International Ltd. at any time. I acknowledge that WIBS International Ltd. is not obligated to provide me with any Pre-Release Software.

I understand that the Pre-Release Software and any information concerning the Pre-Release Software, the Beta Tools, and any other information disclosed by WIBS International Ltd. to me in connection with this Agreement (collectively, “Confidential Information”) is confidential and proprietary to WIBS International Ltd. I agree not to disclose, publish, or otherwise disseminate any Confidential Information to anyone other than my authorized end users, or as otherwise expressly permitted or agreed to in writing by WIBS International Ltd.

I understand that I may need to provide my own devices to participate in the Beta Program and that I may need to remove certain pre-loaded, commercial software from my devices in order to load the Pre-Release Software. I understand that once I load the Pre-Release Software onto my devices, I may be unable to revert back to the pre-loaded, commercial release of the software or any earlier release of the Pre-Release Software.

I understand that WIBS International Ltd. may collect diagnostic, technical, and usage logs and information from my authorized devices that are running Pre-Release Software for the purpose of improving their products and services. I acknowledge and agree that WIBS International Ltd. may share such information with partners and third-party developers for the same purpose.

I agree to comply with all applicable laws and regulations with respect to any use or collection of data and information through the use of the Pre-Release Software and my deployment of authorized devices to my authorized end users. I represent and warrant that I will provide sufficient notice and disclosure of the terms of the Agreement, and obtain all necessary rights and consents for the use, testing, and evaluation of Pre-Release Software and the direct and incidental collection of authorized end user data that may arise.

I acknowledge and agree that unauthorized disclosure or use of Confidential Information could cause irreparable harm and significant injury to WIBS International Ltd. I agree that WIBS International Ltd. will have the right to seek immediate injunctive relief to enforce obligations under this Agreement in addition to any other rights and remedies it may have.

I have read and understood the WIBS International Ltd. Beta Software Program Agreement and agree to be bound by its terms and conditions. I acknowledge that my participation in the Beta Program is subject to the terms and conditions of the Agreement.
